User Agreement for Aarya AMS
Effective Date: 01 January 2025
This User Agreement ("Agreement") governs the relationship between Aarya AMS ("we," "us," or "our") and the end users ("you" or "your")who receive our gadget protection services, which are facilitated exclusively through authorized retailers ("Retailers"). By utilizing these services through a Retailer, you agree to the terms set forth in this Agreement and consent to the necessary data collection and usage for service facilitation.
Aarya AMS provides gadget protection services for a wide range of devices, covering essential components of gadgets such as daily-use gadgets, home appliances, and kitchen appliances. All protection services are initiated by authorized Retailers and are not directly available to customers.
- Retailer Facilitation: All service-related activities, from registration to claims processing, are exclusively conducted through Retailers.
- Eligible Devices: A comprehensive list of eligible device categories is available on our platform and through your Retailer. Protection is limited to items within these specified categories.
To enable us to deliver effective and efficient service, certain information is required from you. By agreeing to this Agreement, you authorize Aarya AMS and your Retailer to collect and process this information solely for service purposes. Required data includes, but is not limited to:
- Personal Information: Full name, contact information (email, phone number, address), and identification details such as Aadhar card.
- Bank Information: Account details for processing reimbursements or refunds, where applicable.
- Device Details: Information related to your protected device(s), including make, model, serial number, purchase date, and proof of purchase.
All data is collected solely to facilitate service activation, device registration, and claims processing as applicable.To ensure smooth service activation and efficient handling of protection claims, you agree to:
- Provide Accurate Information: Submit accurate, complete, and up-to-date information through your Retailer. Incorrect or incomplete information may delay service activation or result in denial of service.
- Retailer as Point of Contact: Acknowledge that all communication with Aarya AMS, including service requests, is conducted through the Retailer, who will act as your primary point of contact.
- Review Protection Details: Ensure you understand the terms of the protection, including coverage scope, conditions, and limitations, as provided by the Retailer.
Service eligibility is based on certain criteria outlined in the selected protection plan. By agreeing to use Aarya AMS services, you acknowledge and accept these criteria, which include:
- Device Eligibility: Only devices within the eligible categories, as listed on the Aarya AMS platform, qualify for service. Any devices outside of these categories are ineligible.
- Activation Requirements: Activation of service is contingent upon accurate and complete submission of information by the Retailer on your behalf, as well as any other prerequisites specified by Aarya AMS.
Aarya AMS provides a robust level of gadget protection; however, certain limitations and exclusions apply. By agreeing to this User Agreement, you understand and accept these conditions:
- Unauthorized Repairs: Repairs conducted by unauthorized service providers will result in cancellation of service coverage.
- Intentional or Negligent Damage: Coverage does not extend to damage resulting from misuse, intentional damage, or negligent handling of the device.
- Non-eligible Gadgets: Gadgets not included in the Aarya AMS eligible category list are not covered by this service.
Fees for Aarya AMS services are established and communicated by the Retailer, with fee structures based on the specific type of device and level of coverage selected. You acknowledge the following regarding fees:
- Retailer Fees: Service-related fees will be determined and processed by the Retailer. If you have questions about fees, please contact your Retailer directly.
- Reimbursements: In cases where a reimbursement is warranted, Aarya AMS will issue funds through your Retailer using the banking information provided.
Service continuation and termination are subject to the terms outlined below:
- Renewal: Some plans may allow for renewal upon reaching the end of the initial protection period. The Retailer will inform you of any renewal options if applicable.
- Termination of Service: Aarya AMS reserves the right to discontinue service if there is a breach of the terms in this Agreement, or if fraudulent activity is suspected.
Aarya AMS strives to deliver high-quality services; however, by agreeing to use these services, you acknowledge the following limitations of liability:
- No Liability for Indirect Damages: Aarya AMS is not responsible for indirect or incidental damages, such as data loss or loss of use, arising from the service or its use.
- Limited Protection: Our service provides only the repairs and protections specifically outlined in your selected plan and does not cover loss or damage outside the agreed terms.
By accepting this Agreement, you agree to indemnify and hold Aarya AMS harmless from any claims, damages, or expenses arising from:
- Misrepresentations or inaccuracies in the information provided for service facilitation
- Breaches of this Agreement, including unauthorized use of Aarya AMS services
- Any actions by the Retailer on your behalf that may impact your service experience or compliance with applicable regulations
Aarya AMS reserves the right to update or modify this User Agreement at any time. Significant changes will be communicated to Retailers, who will, in turn, inform you. Continued use of Aarya AMS services following such modifications constitutes your acceptance of the updated terms.
